These Terms of Service (“Terms”) govern the use of the „AI Viditelnost a SEO" (AI Visibility & SEO) add-on (“Service”) for the Shoptet e‑commerce platform, available at aividitelnost.cz. The Service is provided by:

„AI Viditelnost a SEO" (AI Visibility & SEO) is a Shoptet add-on that helps e‑shop operators improve their visibility in search engines and AI systems. The scope and specific features of the Service may change over time.
Shoptet a.s. is not the provider of this Service. Shoptet bears no responsibility for the functionality, support, or data processing of this add-on. The contractual relationship is exclusively between you and Marketing Miner s.r.o.
The Service is intended for business entities (e‑shop operators on the Shoptet platform). By using the Service, you represent that you are acting within the scope of your business activity. You must have an active e‑shop on the Shoptet platform to use the Service.
To provide the Service, we access your Shoptet e‑shop data through the Shoptet API. By installing the add-on, you authorize us to access specific API endpoints required for the Service, including data on products, categories, pages, articles, and orders.
We process order data exclusively for the purpose of calculating aggregated business statistics (such as total revenue, average order value, or conversion rate). Personal data contained in orders (customer name, email, address, etc.) is not stored — it is processed only temporarily in server memory (RAM) and deleted immediately after statistics are calculated. Optionally, you may connect your Google Search Console and/or Google Analytics 4 accounts via Google OAuth. This connection is voluntary and the Service works without it. If you connect these services, we access your data exclusively for the purpose of providing user-facing features of the Service (dashboards, analyses, recommendations) and in compliance with the Google API Services User Data Policy, including Limited Use requirements. We may also use our own data obtained from publicly available sources and/or data from third parties to provide information related to search engines, AI visibility, and related areas.
Use of Third-Party AI Services. To provide certain features of the Service — for example, personalized SEO recommendations and optimization suggestions — non-personal operational data (such as URLs, keywords, website performance metrics, aggregated statistics) may be processed through external third-party AI services. We do not send any personal data to these services. These AI services do not use data submitted in the course of providing the Service for training, developing, or improving their models. This section constitutes a data processing agreement within the meaning of Art. 28 GDPR between you (controller) and Marketing Miner s.r.o. (processor) in relation to personal data of your e‑shop customers.
The subject matter of processing is access to your e‑shop order data through the Shoptet API for the purpose of calculating aggregated business statistics (total revenue, average order value, conversion rate, revenue per category/product, etc.). Processing takes place for the entire duration of the add-on installation.
The Shoptet API returns orders including personal data of end customers (name, email, address, phone number). We process this personal data exclusively temporarily in server memory (RAM) — we extract only the necessary business data (order price, date, product code, order status) and personal data is deleted immediately thereafter. We do not store, log, or transfer customer personal data to third parties. We store only the resulting aggregated statistics, which contain no personal data.

By installing the add-on and accepting these Terms, you instruct us to process personal data as described in this section. We will not process personal data of your e‑shop customers in any other manner or for any other purpose than stated herein, except where required by applicable law — in which case we will inform you in advance, unless prohibited by law.
We will ensure that persons authorized to process personal data are bound by a duty of confidentiality.
We have implemented appropriate technical and organizational measures to protect personal data, in particular: customer personal data is not persisted on any storage (processing takes place exclusively in RAM), API access is secured with encrypted connections (HTTPS), and server access is restricted to authorized personnel.
For the processing of personal data of your e‑shop customers, we use Amazon Web Services EMEA SARL as the provider of the server infrastructure on which the Service runs. Personal data exists on this infrastructure exclusively temporarily in memory (RAM) for the time necessary to calculate aggregated statistics and is not persisted, logged, or otherwise stored. By installing the add-on, you grant general consent to the use of sub-processors. We will inform you of any changes.
We will provide you with reasonable assistance in fulfilling your obligation to respond to data subject requests to exercise their rights under GDPR. Given that we do not persist customer personal data, we do not have access to it after processing.
After uninstalling the add-on or terminating the Service, there is no customer personal data to delete, as it is not retained long-term. Aggregated statistics (which contain no personal data) will be deleted within a reasonable period after termination of the Service or upon your request.
Upon your reasonable request, we will provide you with the information necessary to demonstrate compliance with the obligations set out in this section.

All rights to the Service, its code, design, data models, and aggregated datasets remain the property of Marketing Miner s.r.o. You are granted a non-exclusive, non-transferable, revocable license to use the Service for the duration of your subscription.
We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service depends on third-party platforms (Shoptet, Google, etc.), the availability of which is beyond our control. We may perform scheduled maintenance from time to time.
The Service provides data, analyses, and recommendations. We do not guarantee any specific SEO results, increases in traffic, improvements in revenue, or search engine rankings. All displayed metrics are estimates based on publicly available sources and third-party sources and may not be entirely accurate.
The Service is provided “as is” and “as available.” To the maximum extent permitted by applicable law, we disclaim all warranties, whether express or implied. Except where such liability cannot be excluded or limited under mandatory provisions of applicable law, we shall not be liable for any damages arising in connection with the Service or these Terms, whether direct, indirect, incidental, special, consequential, or punitive, including but not limited to loss of profits, revenue, data, or business opportunities, regardless of the cause of action or theory of liability.
These Terms are effective for the entire duration of your use of the Service. You may stop using the Service at any time and uninstall the add-on through the Shoptet administration.
We may suspend or terminate your access to the Service at any time, including without cause, with reasonable advance notice. In the event of a breach of these Terms, we may suspend or terminate access without prior notice.
We may update these Terms from time to time. The current version is always available at aividitelnost.cz/en/terms-of-service. By continuing to use the Service after changes are published, you agree to the updated Terms.
These Terms are governed by the laws of the Czech Republic. All disputes shall be resolved by the competent courts of the Czech Republic.
